PERSONAL DATA PROCESSING POLICY
Administrator of your (hereinafter referred to as 'You', the 'Customer') personal data in the online store eNoty.eu (hereinafter referred to as 'e-shop eNoty.eu') is Blesk Market s.r.o. registered in the Czech Republic at the office at Ostravská 544, 735 41 Petřvald, company identification No. 64084841 (hereinafter referred to as 'we', 'Blesk Market'). As the personal data administrator we are responsible for ensuring that the data in e-shop eNoty.eu are being processed in accordance with the provisions of the Civil Code of the Czech Republic, Act No 110/2019 of the Civil Code, and regulation in EU law on data protection and privacy for all individual citizens of the European Union (EU) and the European Economic Area (EEA), The General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as 'GDPR').
This policy provides you with information within the following sections:
1 WHAT PERSONAL DATA IS COLLECTED AND THEIR PURPOSE
1.1 If you contact us through our website, you may be asked to fill in certain details about yourself, which are being used to get back to you and provide you with the information you had asked for. To manage these customer service interactions with you we need to know:
- your first and last name,
- email address,
- telephone number.
1.2 In order to handle your order/purchase of goods on our online store, we need certain details about you in order to make the purchase contract with you. These personal data include:
- your first and last name,
- shipping and billing addresses,
- email address,
- telephone number.
In case you shop for an organization, we will also ask for the following information:
- name of the organization,
- ID,
- VAT reg no.
1.3 If you order/purchase goods on our online store, your first name, last name and email address may be also for promotional communication, to inform you about new releases, special offers and discounts. You can unsubscribe from receiving such emails from us anytime by clicking on a link at the bottom of the emails or by contacting us at info@enoty.eu.
1.4 If you create an customer account at our website, we process also the information you will provide to us through the account including your purchasing history at our online store or your wishlist for future purchases in order to send you our newsletter.
1.5 We automatically process cookies, small text files created upon a visit to a website. Cookies are being used as a standard tool for the storage of information about visits to a website. At our website we use cookies for the following purposes:
- to keep you signed in on our website if you have created an customer account,
- to allow you to buy goods and services at our website (e.g. to remember what is in your shopping basket),
- anonymous statistics of customer movement on our website for the purpose of user experience improvement.
Only relevant and necessary personal data are being requested and they are being processed in a lawful and transparent manner. If case you still wish to restrict use of cookies to above mentioned purposes on our website you can do so by using internet browsers (e.g. Internet Explorer, Google Chrome, Mozilla Firefox, Safari) in anonymous browsing mode.
2 WHO WE SHARE YOUR DATA WITH
2.1 We share your personal data in the necessary extent with the third parties in the case of delivery by the carrier you have chosen when you have ordered goods at our website. These personal data include:
- your first and last name,
- shipping addresses,
- telephone number.
2.2 If you purchase goods on our e-shop eNoty.eu (hereinafter also as the 'Buyer'), we may share
- your email address
with the operators of portal Heureka.cz, within the program 'Ověřeno zákazníky' (Verified by customers) for a purpose of sending satisfaction questionnaires and improving the Buyer's satisfaction with the buying process on our e-shop eNoty.eu. The legal basis for processing of the personal data is the legitimate interest of Blesk Market, Section 6 (1) of GDPR, to determine the Buyer's satisfaction with the buying process. The satisfaction questionnaire concerns all Buyers in e-shop eNoty.eu, which did not refuse the receiving of such commercial communication in accordance with the provisions of Section 7 (3) of Act No 480/2004 of the Civil Code. The satisfaction questionnaire is being sent to the Buyer after each purchase at e-shop eNoty.eu. The operators of the portal Heureka.cz is entitled to use the shared Buyer's email address solely for the purpose of generating and sending satisfaction questionnaires as explained in Terms and Conditions of the program 'Ověřeno zákazníky'. The Buyer can unsubscribe from receiving such emails anytime by clicking on a link at the bottom of the emails. In case of raising an objection, the questionnaire will not be sent to the Buyer no more.
2.3 Please note that our company does not process information about your credit cards (applies to direct payments). Credit cards information are being processed solely by secured Payment Gateway and authorized bank institution.
3 HOW LONG DO WE KEEP YOUR PERSONAL DATA
3.1 We shall process your personal data for the entire duration of the contractual relationship between you and us.
3.2 If your personal data processing is based on consent (as in section 1.1, 1.2, 1.3), we process your personal data, in general, for 5 years or until such consent is withdrawn. To withdraw your consent with personal data processing you can always contact us at info@enoty.eu. In terms of promotional communication, you can also withdraw your consent by clicking on a link at the bottom of the emails.
3.3 Your personal data connected to you customer account (as in section 1.4) will be processed until the cancellation of such account. In case you create an customer account on our website and will not make any purchases for 5 years, we reserve the right to delete your customer account.
3.4 Please note that the personal data necessary for the due rendering of services or for the fulfillment of all our duties, ensuing either from the contract between us or from generally binding legal regulations have to be processed regardless of whether you granted your consent for the period set out in the relevant legal regulations and in compliance therewith (e.g. tax laws, document record management system).
4 YOUR RIGHTS REGARDING PERSONAL DATA PROCESSING
You are entitled to the following rights in relation to processing of your personal data:

4.1 Right to access: You can always ask us to provide you with the overview of your personal data that we have stored. You are entitled to access the following information connected with your personal data:
- what is the purpose for processing your personal data,
- which categories of your personal data do we use,
- who, besides us, receives your personal data,
- planned period of storage of your personal data,
- whether you have the right to claim the correction or deletion, restriction of personal data processing or to raise an objection to such processing,
- information on the source of the personal data in case we did not obtain them from you.
4.2 Right to rectification: You have the right to request rectification of your personal data we hold that are incorrect or incomplete. You can request changes of the personal data by contacting us at info@enoty.eu. In case you are registered customer on our website, you can make the amendments of your information at your customer account.
4.3 Right to erasure: You may also claim the deletion of your personal data (this does not apply to data in documents that are subject to the obligation of archiving under the law, e.g. invoices or credit notes). In case we need your personal data to determine, execute or defend our legal claims, your request may be rejected (e.g. if we have an overdue invoice in your name or if the complaint procedure is in progress).
You are entitled to the deletion of data in the following cases:
- the personal data is not needed for the purposes for which it was being processed,
- the personal data has been processed unlawfully,
- you have objected to the processing of personal data and your interest in the particular situation prevails over ours,
- the deletion obligation is stipulated by a special legal regulation.
4.4 Right to raise an objection: Certain personal data are being processed for purpose of direct marketing or on the basis of our legitimate interest. If you have concrete reasons, you are entitled to raise an objection to the processing of your personal data. In such case, you personal data will further not be processed for this purpose.
4.5 Right to restriction of processing: You shall be entitled to us restricting the processing of your personal data in the following cases:
- you deny the accuracy of your personal data,
- your personal data is processed unlawfully,
- we do not need your personal data for processing purposes anymore, but it is needed to determine, execute or defend your legal claims,
- you raised an objection under the preceding paragraph.
In other words, we must restrict the processing of your personal data (except storage of the data) if any of the above mentioned conditions applies.
4.6 Right to lodge a complaint: If you believe that your personal data has been processed unlawfully, you are entitled to lodge a complaint at the Office for Personal Data Protection.
5 PERSONAL DATA SECURITY
As we are determined to keep your personal data safe, we regularly check and continuously improve our security measures. We store all of your personal data at our own secured servers.
These Privacy Policy Regulations are an integral part of General Terms and Conditions and are effective from 24th October 2019.
